Australian Government Ministers, Departments and Agencies under Australian Commonwealth laws are provided with merit reviews on the decisions that they passed out. The independent body that provides these merit reviews is the Administrative Appeals Tribunal (AAT).

What is the AAT review

The AAT has the right to conduct a review on any decision that has been made and there various divisions that are relevant in providing a review for different areas. For example, the Migration and Refugee Division is in charge of the immigration area. It is the division that reviews decisions made by the Department of Immigration and Border Protection (DIBP).

Every AAT review is supervised by a Member. A Member is someone who has been appointed by the Governor-General. The Member could be from a wide variety of backgrounds as it is not a requirement that they should be a lawyer.

The AAT review and your Australian Visa Application

How does the AAT affect a visa holder? In the case that your visa has been refused or cancelled, you may seek a review from the AAT. The Administrative Appeals Tribunal Review will analyse the facts, law and policy that are related to the decision made by the DIBP. The AAT Review has the authority to affirm a decision, vary a decision, set aside a decision and substitute a decision, or remit a decision back to the Department for reconsideration.
